No Executive Amnesty

So the Scofflaw-in-Chief is going to commandeer the American airwaves tonight and jabber about how, through executive overreach, he’s going to countermand and overthrow the laws duly enacted by Congress by granting amnesty to millions of illegal aliens.

NOTE: Obama’s handlers and overseers, along with many of his remaining followers, object to the word “Amnesty” but not to the meaning of his acts in this matter.

What Obama’s executive amnesty really means is:

  • The boy will once again prove himself a liar by not drawing a distinction between conscious and inadvertent violators of America’s immigration laws as he repeatedly claimed we must do.
  • He’ll  cause yet another surge of illegals from Central and South American countries, just as his previous suspension of enforcement action against the so-called Dreamers in June of 2012 did.
  • The boy’s reported plan would legalize as permanent U.S. residents many tens of thousands of illegal alien criminals – ones that are criminal far beyond merely being violators of immigration law. Like his previous actions, Obama’s amnesty would include: murderers, rapists, kidnappers, and a host of other criminals whose offenses the Obama Regime doesn’t consider “serious.”
  • His actions, if allowed to stand, will cost the American taxpayers tens, if not hundreds, of billions of dollars a year since most the recipients of the boy’s amnesty will be uneducated, unskilled, poverty-stricken individuals who will instantly qualify for any and all means-tested social programs on the books.

Thankfully but not unexpectedly, Congress – with the stereotypical exception of the lame-duck democrats in the Senate – are not taking Obama’s attempt at gross executive overreach and infringement of the constitutionally mandated Separation of Powers lying down. They are already moving to defund those parts of the federal bureaucracy which would be needed to implement Obama’s planned executive amnesty.

This is, in my opinion, a moderately good response but it is difficult to fully realize and contains more form than function due to the bureaucracies in question having a backlog of various supplies and means to implement, in the near-term at least, Obama’s atrocity. I believe that America would be better served if Congress thought less about “No Executive Amnesty” and much more about “No Amnesty For The Executive.”

Instead of merely defunding those portions of the ICE that would allow Obama to legalize these illegal aliens, Congress should also defund all portions of the US Secret Service that do not direct pertain to safeguarding the payment and financial systems of the United States.

Let we, the People, who are the true law of- and keepers of justice in the land, decide whether or not to extend amnesty to Obama. 😉

Obama Speaks Loudly

Obama has, of late, been talking tough and making threats to act independently of Congress to enact his agenda for domestic policies through various executive orders. To many the boy is coming across as and angry, trash-talking would-be tyrant. To others, mostly those who believe they’ll benefit from his agenda, he’s likely coming across as a dynamic reformer who seeking to succeed despite the efforts of his – and theirs – avowed enemies.

But the thing is that Obama may talk a lot and quite severely and defiantly, as if he strives to be the tyrant and take power and rule over America without interference from Congress, but his actions, or lack thereof, mean that this is just posturing – all presentation and little performance.

But then Obama has always talked like he wanted to turn longstanding traditions upon their heads as it were and create his own paradigm. In this case he just seems to be twisting President Theodore Roosevelt’s famed adage, “Speak softly, and carry a big stick,” into his own lamentable, “Speak loudly, and carry a small twig.” – at least when it comes to Executive Orders (EOs).

No, Obama doesn’t seem to actually be the type to stand up and openly defy both Congress and the constitutionally mandated Separation of Powers in order to achieve something…anything. At the very beginning he started out that way but one of his first EOs, directing the NIH to develop revised guidelines on federal funding for embryonic stem cell research, was overturned in federal court because it was illegal and he backed off on such things. Since then most, though certainly not all, of his EOs having been non-meaningful and within the limits the Constitution sets for his powers as POTUS.

The primary exception to this is the boy’s misuse of the War Powers Act to wage foreign wars at the bequest of foreign governments without the approval of Congress.

No, if Obama is a tyrant or would-be tyrant, he’s not going to be an open and honest one. His strong words are nothing but jabberings meant to inflame the Liberals and further polarize them against normal, mainstream Americans and the politicians that they elect to serve them. Instead, what tyranny the boy can enact will be performed without EOs and by various departments in the Executive, e.g., the IRS, the FBI, and the EPA and will be done in a manner that ensures that Obama has plausible deniability of any involvement.

Even this may be case of be giving Obama too much credit for planning and manipulation. His sin may be nothing but creating a climate of hyper-partisanship, intolerance, hatred, and desperation within the Executive – sort of a case of, “Won’t someone rid me of this meddlesome priest?” with the IRS, FBI, and EPA playing the parts of sirs Reginald FitzUrse, William de Tracey, Hugh de Morville, and Richard le Breton and American Conservative groups and businesses playing the part of the Archbishop of Canterbury, Thomas Becket.

Obama HESC Plan Balked

6-Day Old Human EmbryoOn Monday, August 23, 2010 a US federal judge blocked the Obama administration from funding human embryonic stem cell research via the National Institutes of Health (NHS). The court ruled that the President Obama’s planned financial support Human Embryonic Stem Cell (HESC) research violates an existing  federal law barring the use of taxpayer money for experiments that destroy human embryos.

So much for President Obama March 9, 2009 Executive Order 13505, with which he supposedly tried to fund the practice with taxpayer money.

From the Washington Post:

U.S. District Judge Royce C. Lamberth issued a preliminary injunction that prohibits the National Institutes of Health from funding the research under the administration’s new guidelines, citing an appeals court’s ruling that the researchers who had challenged the less-restrictive policy have the legal standing to pursue their lawsuit.

The decision, a setback for one of the administration’s most high-profile scientific policies, was praised by opponents of the research.

The preliminary injunction will, if some vestige of the laws of America still exist, be followed with a final ruling that permanently blocks Obama’s directive. This is not because HESC research is wrong but because a President’s Executive Orders do not overrule the laws as created by the Congress and, therefor he cannot approve such funding when a law explicitly prohibits it.

That is a much more important point than whether or not Human Embryonic Stem Cell Research gets federal funding – unless one suddenly likes the idea of the “Imperial Presidency.”
