Decent Side-Boobs
Back in 2003 ABC aired an episode of NYPD Blue that “featured” a seven-second shot of Charlotte Ross’ naked butt and the side of one of her breasts as she prepared to take a shower.
The always eager censors at the Federal Communications Commission (FCC) stridently screamed foul and hit the network with a $1.2 million fine for indecency in 2008.
Sadly for the FCC, on Tuesday, January 4, 2010 a federal appeals court in New York struck down the fine.
The 2nd U.S. Court of Appeals in Manhattan decided Tuesday to nullify a $27,500 penalty that the FCC imposed on ABC and 45 of its affiliate stations after the image was broadcast on the police drama for less than seven seconds in February 2003. The combined fine was greater than $1.2 million.
The appeals court said its finding was consistent with its decision last year that TV stations can no longer be fined for fleeting, unscripted profanities uttered during live broadcasts.
Of course the FCC should have, and probably did, expect this ruling. It is completely consistent in findings and reasons with the Court’s earlier rulings on “fleeting obscenity” and “transient nudity,” rendered on July 13, 2010 and July 21, 2008 respectively.
It also falls perfectly in line with other, lower court decisions regarding indecency and obscenity.
I’d like to think that the FCC and other Federal Agencies, especially those solely appointed by the Executive, would sooner rather than later, understand that their inappropriately and unconstitutionally vague mandates and regulations are antithetical to everything that is truly American and an abomination to we, the People.
I rarely say, “There aught to be a law,” because that’s how agencies like the FCC got out of hand in the first place, but perhaps this should be the exception that proves the rule.
Perhaps they should make a law that makes it a federal felony for any member of- or employee of the federal government to knowingly violate the US Constitution. Preferably it would be a capital crime punishable by death and only punishable by death – specifically, hanged by the neck until dead and their corpses left to rot at the foot of the Capitol steps as a warning.
It would certainly save a lot of taxpayers’ money if they weren’t consistently in expensive and losing litigation trying to defend their wrongdoing.
I’m not going to expect it though. Such agencies do not willingly relinquish any form or level of power; it must be taken from by force, either of fiat by the Courts or of arms by we, the People.

Wow, massive shooting in Arizona involving a Congresswoman, Judge, and numerous innocent bystanders, and you are posting an FCC ruling and a gallery of T&A.
Bravo! For today at least, it looks like even you decided to pull back on your own brand of charmingly intelligent violent rhetoric.

Not exactly, Kelly.
I’m still figuring out how I feel about it – beyond a tired frustration with the Leftists’ instant and unfounded attacks against any and all Conservatives who, like me, speak their mind.
Also, I just didn’t and still don’t care that much about it.
So Gifford got shot? I’m not the sort to get upset over a politician being taken out, especially one from the enemy faction. Such risks are part and parcel of politics – or should be if Liberty is to be maintained.
I’m trying to dredge up some shock, horror, and/or outrage over the innocent, presumed innocent, and quasi-innocent victims of the rampage but I’m falling short of the mark on that score.
I’m really too inured to violence for that though. I’ve just been too many places where this is normal to the point of being not newsworthy and have too much knowledge of how many death threats politicians and pundits get to feel much when violence actually happens.
Hell, Kelly! I get more death threats – some credible enough that I had to report them – than most politicians, though far fewer than the national pundits.
So…lacking any passion for the issue, I’ve chosen to keep with my scheduled posts instead and a few addressing ancillary matters in the Loughner-Giffords matter.

Well, it’s been nice trying to find common ground, but on this one, I am afraid I am going to have to bug out. You are using war terms, calling a Blue Dog Democratic low level congresswoman “the enemy faction”, blah blah blah. You are part of the problem, yet when you get death threats, you report them to……the very authorities you profess to want ‘taken out’.
Keep swimming in your murky pond. I am afraid we are going to have to end our association. I do not want to be linked in any way to your belief system and your postings.
I will not be reading nor commenting on your post about Giffords, as I have read enough in your answer here.
Do me a favor and remove me from your blogroll, please.
I am going to unfriend you on FB, don’t take it personally – I am sure you will not. If you cannot muster up feelings for a 9 year old child as collateral damage, then my unfriending wont ruffle a hair on your head.

I’m sorry to hear that, Kelly. I do, however, understand that some ideologies and their adherents just don’t mix well.
As for Christina Taylor Green, the nine year-old in question, I’d like to feel more outrage, but all I can muster is a tired frustration that, once again, someone went berserk after multiple chances for society to have stopped them beforehand.
