While I&#039;m not in favor of Medicare, Medicaid,etc... no litigant challenging their existence has ever challenged their constitutionality. This is because those program&#039;s financing mechanisms proceed under the taxing and spending powers, together with the commerce clause.

That is quite different from Congress usurping powers not granted to it - and specifically denied to it - to force Americans to purchase a product or service as condition to living in the country.</description>
